Terms & Conditions – BookMyBoat

1. Arrival & Timing

• Guests are requested to arrive at least 15 minutes before the scheduled departure time.

• If guests arrive late, the trip will end at the originally scheduled time. No extra time will be provided for late arrivals.

• If our team or the captain causes a delay, additional time will be provided to ensure you receive your full booking duration.

2. Safety & Captain’s Authority

• All guests must follow the captain’s instructions and safety guidelines at all times.

• The captain reserves the right to:

  • Cancel or postpone a trip due to bad weather or safety concerns. In such cases, the customer will be compensated or rescheduled.

  • Terminate a trip immediately in cases of unsafe behavior, intoxication, failure to follow safety rules, or inappropriate conduct. In such cases, no refund will be issued.

• The captain’s decision is final and non-disputable.

3. Children On Board

• Children must be supervised by an accompanying adult at all times.

• Life jackets are mandatory for all children during the trip.

4. Behavior & Conduct

• Any form of racism, hate speech, harassment, or discrimination (based on race, gender, religion, nationality, sexual orientation, or any other ground) is strictly prohibited.

• Such behavior will result in immediate termination of the trip without refund and may lead to legal action.

5. Cancellation & Refunds

• If BookMyBoat cancels a trip due to safety concerns or weather conditions, customers will receive compensation or rescheduling options.

• If a trip is canceled or terminated due to guest misconduct, intoxication, failure to follow rules, or harassment, no refund will be issued.

• In the case of uncontrollable or unforeseen circumstances (e.g., sudden mechanical issues, port restrictions, emergencies), no refunds will be issued.

6. Defamation & Public Statements

• Guests agree that in situations where the company issues a refund or compensation as per these Terms, they will not engage in actions intended to damage the company’s reputation, including but not limited to:

  • Posting false or defamatory reviews.

  • Encouraging others to post misleading feedback.

  • Publicly misrepresenting their experience.

• The company reserves the right to pursue legal action for defamation or damages caused by false public complaints.

7. Media & Privacy

• The company may take photos and videos during the charter for safety monitoring and promotional purposes.

• These images may be shared on social media, websites, advertisements, or promotional content.

• If any guest does not wish to be photographed or recorded, they must inform the captain before departure.

8. Right to Refuse Service

• The company reserves the right to refuse service to any individual or group at any time, before or during the charter, if deemed necessary by the captain or management.

• Grounds for refusal include (but are not limited to): intoxication, unsafe behavior, harassment, failure to comply with safety rules, or any conduct deemed inappropriate.

9. Liability Waiver

• By boarding the yacht, all guests acknowledge that boating activities involve inherent risks, including but not limited to slips, falls, water-related incidents, and weather conditions.

• Guests agree to assume full responsibility for their own safety and that of their children or dependents.

• BookMyBoat, its owners, employees, and contractors shall not be held liable for any injury, accident, illness, or loss of life that occurs during the trip, except in cases of proven negligence.

10. Damage & Responsibility

• Guests are responsible for any damage to the yacht, equipment, or property caused by negligence, misconduct, or failure to follow captain’s instructions.

• The company reserves the right to charge guests for repair or replacement costs resulting from such damages.

11. Substance & Alcohol Policy

• Consumption of alcohol is permitted in moderation.

• Illegal substances and drugs are strictly prohibited.

• Excessive intoxication that jeopardizes safety may lead to immediate termination of the trip without refund.

12. Personal Belongings

• Guests are responsible for their own personal belongings.

• The company is not liable for lost, stolen, or damaged items during the charter.

13. Force Majeure

• BookMyBoat shall not be held responsible for cancellations, delays, or modifications caused by events beyond its reasonable control, including but not limited to:

  • Natural disasters, storms, or severe weather.

  • Government restrictions or regulations.

  • Strikes, labor disputes, or mechanical breakdowns.

• In such cases, no refunds will be issued.

14. Acceptance of Terms

• By booking with BookMyBoat, all guests confirm that they have read, understood, and agreed to these Terms & Conditions.

• The person making the booking is responsible for ensuring all members of their group are aware of and comply with these terms.

15. Governing Law

• These Terms & Conditions are governed by the laws of Ontario, Canada.

• Any disputes arising shall be subject to the jurisdiction of the courts in Toronto, Ontario.
